The Constitution for the Republic of North Dakota

Preamble:  

We the People living on the land under common Law within the Republic of North Dakota, with a decent respect to one another and to the Laws of Nature and Nature's God as Foundation, with firm reliance on the Constitution for the united States of America of 1787, to include resolution and ratification of the first thirteen original Amendments as amended prior to 1820, the Bill of Rights, the Northwest Ordinance of 1787, The Articles of Confederation, the Declaration of Independence of both 1776 and 2020, do hereby ordain and establish these Articles of Constitution for the Republic of North Dakota. For purpose of reference, the borders of the Republic of North Dakota shall be consistent with the standing borders of the State of North Dakota.

Interim Constituting Body

For establishment reasons, there shall be an interim constituting body created to form the Republic of North Dakota and secure its existence until an official Election can be held. To be eligible to election, all requirements imposed in this Constitution shall be in full effect upon them.

Article One:

Legislative

Section One: All legislative Powers herein granted shall be vested in an Congress, consisting of a Senate and a House of Representatives.

Section Two: The House of Representatives shall be comprised of Members chosen every second Year by the People of the County in which the Representative is to serve. There shall be Elected, two Representatives for each of the fifty-three counties, who shall each serve alternating four Year terms. Immediately in con-sequence of the first Election, they shall be divided, one Representative of each County whose term shall expire at the end of the second Year, the second shall serve their full term. The first Representatives shall not be eligible to re-election immediately following their first term, nor shall any Representative serve more than two terms.
All eligible candidates shall have attained the age of twenty-five Years; and must, at the time of Election, be an inhabitant of the united States of America fifteen Years and been domiciled within the Republic of North Dakota ten years, and shall not have been a member of the State of North Dakota government within the prior ten years. Said Candidate shall have lived inside the borders of their proposed County for at least five years before being eligible to the Ballot for Election. Vacating the seat in the County of Election or the Republic of North Dakota more than twenty-one days without consent of the Congress shall be construed Vacation of Office.
The Vice President of the Republic of North Dakota shall serve as President of the House of Representatives, but shall have no vote unless the House be equally divided.
The House of Representatives shall choose a Speaker, and shall choose its own Officers, and shall have the sole power of Impeachment. When the issue of Impeachment be justly brought, by sworn affidavit or preponderance of evidence, before the House of Representatives, said House must take up the issue to investigate.
When a vacancy shall happen in the within the House of Representatives, there shall be a special Election brought to the People of the represented county to choose a new Representative.

Section Three: The Senate shall be comprised of Members chosen every sixth year by the People of the County where the Senator is to serve. There shall be Elected, one Senator for each of the fifty-three Counties. Immediately in con-sequence of the first Election, they shall be divided by lot into three Classes; the first Class expiring at the end of the second Year, the second Class expiring at the end of the fourth Year, and the third Class expiring at the end of the sixth Year.
In con-sequence of the first Election, no Senator shall be eligible to an immediate second term, nor shall any Senator serve more than two terms.
None shall be Senator who shall not have attained the age of thirty years, been fifteen Years an inhabitant of the united States of America, and been ten Years domiciled in the Republic of North Dakota, and shall not have been a member of the State of North Dakota government within the prior ten years. Said Candidate shall have lived inside the borders of their proposed County for at least five Years before being eligible to the Ballot for Election. Vacating the seat in County of Election or the Republic of North Dakota more than twenty-one days without consent of the Congress shall be construed Vacation of Office.
The Senate shall choose a Speaker from those elected to that house, whose position shall not be up for election on the same cycle as that of the executive Branch, who shall serve to ensure the duties of the Office are faithfully executed in accord with this Constitution and the Constitution for the united States of America. Failure to faithfully execute this clause is cause for Impeachment from Office and Grand Jury trial for Treason.
The Senate shall have the sole Power to try all Impeachments, and all Impeachments justly brought, by sworn affidavit or preponderance of evidence, before the Senate must be tried in accordance with the law. When sitting for that purpose, they shall be on Oath or Affirmation. When the President of the Republic is tried, the Chief Justice shall preside: And none shall be convicted without the Concurrence of two-thirds of the members present. Judgments in cases of Impeachment shall not extend further than the removal from Office and disqualification to hold and enjoy any Office under the Republic: but the Convicted shall nevertheless be subject to Indictment, Trial, Judgment and Punishment according to law.
When a vacancy shall happen in the Senate, there shall be a special Election put to the people of the affected county and they shall choose a new Senator for their county.
The Senate shall choose its own Officers.
The Oath of Office shall read “I do solemnly affirm that I will uphold the Constitution for the united States of America and the Constitution for the Republic of North Dakota and will, to the best of my ability, faithfully execute the office to which I have been duly elected, in accordance to the laws of the Republic of North Dakota, so help me God.” It shall then be autographed by the one taking the Oath, then by two other living People, then stamped with the Great Seal of the Republic of North Dakota and filed into the Records by Republic Recorder, and shall be Recorded within the Journal of that Office and published at the next regular interval.
Section Four: Members of both Houses shall keep a Journal of proceedings and shall publish the same from time to time, except an Act of War concerning the Republic; and shall publish the yeas and nays concerning each issue or bill brought before or originating within them.
Section Five: Three-fourths of each House shall constitute a quorum to do business; such that if only three-fourths are present, the Vote must be unanimous; but a smaller number may adjourn from day to day and may compel the attendance of absent members in such manner and under such penalties as each House may provide. Neither House may, without consent of the other, adjourn for more than three days or convene at a location other than where the Houses are seated.
Section Six: Each House shall determine the Rules of its own proceedings, and be judge of the qualifications and returns of its own members; and may, with concurrence of three-fourths of all elected members of the respective House present, expel a member: but in no event shall the rules deny the representation by any Member or skew the expressed intent of the People.
Section Seven: Members of both Houses shall receive compensation for their time in actual Session, to be ascertained by Law, and paid out the Republic Treasury, and that amount shall neither increase nor decrease during their time in Office. There shall not be any further benefit to these positions.
Section Eight: All Bills for raising Revenue for the Republic Treasury shall originate in House of Representatives.
Each Bill or Act proposed, shall fit neatly on one single-side eight-and-a-half by eleven inch page, must be written in plain English, and shall not address more than one particular and specific issue. The Same shall have one-inch margins, be single spaced, and be written in twelve-point Times New Roman or reasonable equivalent. Each Bill or Act, written and passed by two-thirds Vote in one House, shall then be sent to the other House, requiring the same two-thirds to pass: If it be refused, reason shall be given, and it shall then be sent back to the House where it originated to reconsider or scrap it. If scrapped, the issue shall not be brought up again in the same Session. If it pass both Houses, it shall then be sent to the President of the Republic of North Dakota, who shall have ten days, Sundays excepted, to be considered: If approved, the same shall be signed and become Law; if refused it shall be sent with the reason for refusal back to the House of origin to be reconsidered or scrapped. If the President shall not return the Bill within the ten day time, it shall be considered a veto. If it be reconsidered and re-proposed, and the Bill shall pass both Houses by a two-thirds margin, it shall become Law. The Congress may, with three-fourths Vote of both Houses, override a veto.
Both Houses shall have the Right to dissent from, and protest against, an act or resolution which they deem injurious to the Republic or the People at large: And such dissent and reasons shall be entered into the Journal.
The Congress shall provide by law for the removal of justices of the peace and other Officers as needed or petitioned, in such manner, and for such cause, as shall seem just and proper to them. If, at any time, there shall be a Grand Jury convened due to the actions of an Officer, the Grand Jury shall be the authority in the matter.
There shall be no ex post facto laws passed by either House.
Both Houses shall be part-time positions, and shall meet in their respective Houses on the first Monday in March and every business day thereafter until adjourned, and at no other time, unless directed by the President of the Republic of North Dakota, and in no place unusual for their meetings at any time.
The Style of Laws enacted in the Republic of North Dakota shall be “Be it enacted on behalf of the People, by the Congress of the Republic of North Dakota,.”
Census shall be taken every ten years in accordance with standard census practice, the results of which are to be used for Constitutional enumeration requirements only.
No law initiated by the People, is subject to the veto power of the President of the Republic of North Dakota, or to the override Power of Congress, but may be challenged on Constitutional grounds by anyone aggrieved by it, by action brought into the Supreme Court of the Republic of North Dakota. And no law adopted by the People at the polls, shall be amended or repealed except by vote of the People, unless otherwise provided by the initiating measure.
Oath of Office to the Republic of North Dakota shall be taken in the presence of two witnesses within ten days prior to taking Office.
The Congress shall have Power to lay and collect Taxes, Duties, Imposts and Excises, to pay the Debts and provide for the common Defense and general Welfare of the Republic of North Dakota; but all Duties, Imposts and Excises shall be uniform throughout the Republic of North Dakota;
To regulate Commerce with the several Counties, Cities, Townships, and with the Indian Tribes;
To establish a uniform Rule of Naturalization, and uniform Laws on the subject of Bankruptcies throughout the Republic of North Dakota;
To coin Money, regulate the Value thereof, and of foreign Coin, and fix the Standard of Weights and Measures; upon reinstatement of the Republic of the united States of America, this Republic shall acknowledge the national Republic money, value, and standard weights and measurements, and shall acknowledge any standard set for gold and silver values with respect to the Constitution for the united States of America as written in 1789;
To provide for the Punishment of counterfeiting the Securities and current Coin of the Republic of North Dakota;
To acknowledge Post Offices and post Roads set by the Republic of the united States of America;
To promote the Progress of Science and useful Arts, by securing for limited Times to Authors and Inventors the exclusive Right to their respective Writings and Discoveries;
To constitute Tribunals such as administrative and municipal courts, which are inferior to the supreme Court;
To define and punish Piracies and Felonies committed and Offenses against the Law of Nations;
To acknowledge declaration of war by the Republic of the united States of America and make Rules concerning Captures on Land and Water;
To raise and support Armies, but no Appropriation of Money to that Use shall be for a longer Term than two Years;
To provide and maintain Armed Forces;
To make Rules for the governing and regulation of the land and Armed Forces;
To provide for calling forth the Militia to execute the Laws of the Union, suppress Insurrections and repel Invasions;
To provide for organizing, arming, and disciplining of the Militia, and for governing such part of them as may be employed in the Service of the Republic of North Dakota, reserving to the Counties respectively, the Appointment of the Officers, and the Authority of training the Militia according to the discipline prescribed by Congress;
To make all Laws which shall be necessary and proper for carrying into Execution the foregoing Powers, and all other Powers vested by this Constitution in the Government of the Republic of North Dakota, or in any Sector or Officer thereof.
Amendments to this Constitution:

This Constitution may be amended either by the people, or by consent of three-fourths of the members of both Houses who shall then it put before the People to vote on. If the amendment comes from the People, it shall require three-fourths of the People within the Republic to sign it, before being handed to the Congress who shall then enter it into their Journal and take it to the President; it shall then be signed by the President of the Republic of North Dakota, only as Acceptance of Notice, then shall become law.
If proposed by the Congress, it shall pass three-fourths of both Houses, then be proposed to the People upon the next general ballot to pass or fail. If it fail, it shall not be again brought up in the same Session. Any amendment or provision made to the Constitution of the Republic of North Dakota may be removed in the same manner in which it was enacted. At no time shall an amendment to this Constitution, or any subsequent act of the legislature abridge or infringe upon the private, unalienable rights of the People of this Republic.

Article Two:

Executive

Section One: The executive Power herein granted shall be vested in a President of the Republic of North Dakota, who shall hold the Term of four Years and, with the Vice President, chosen for the same Term, be elected by General Ballot to be cast by the People of the Republic of North Dakota, having reached the lawful Age of majority, being eighteen years or older.
Section Two: For those who seek election to the seat of President, the election pattern shall be the same as the Constitution for the united States of America in that, to be elected the President, one Candidate shall singly receive the highest number of Votes cast and the Vice President shall singly receive the second highest. The two shall not campaign together. If no single Candidate receive the requisite majority to be elected, from the those equal in Vote, the Vote shall again be cast between those receiving the highest number of Votes; from the Candidates with the highest number of Votes shall be President and the Candidate with the second highest shall be Vice President. Candidates to the Position of President of the Republic of North Dakota shall have attained the age of thirty-five Years, been born in the united States of America, and been ten Years domiciled in the Republic of North Dakota, and shall not have been a member of the State of North Dakota government within the prior ten years. Vacating the seat in the Republic of North Dakota more than twenty-one days without consent of the Congress shall be construed Vacation of Office.
Those seeking Election to the Office of President of the Republic of North Dakota shall take a test, prior to nomination, demonstrating competency of not only this Constitution, but that of the united States of America and other Founding Documents, to which their conduct and performance of Duties of Office must accord. Failure to pass this test shall be disqualification from the election cycle. They shall again take the test if running for another election cycle. Failing the test a second time shall be a permanent bar from running for the Office of President of the Republic of North Dakota.
Section Three: All Votes cast for President of the Republic of North Dakota shall be signed, counted, tabulated, sealed and delivered to the Speaker of the Senate, who shall open, confirm, and record the same and who shall, as soon as practicable after the election, provide these results to the Secretary of the Republic who shall then enter them into the Republic website. The Ballots shall be kept permanently in electronic form and after seven Years the paper form may be destroyed.
The President shall have the necessary power to execute the Office of President of the Republic of North Dakota, and compel, from any other executive officer, any reports deemed necessary to the execution thereof.
The President shall have the power to grant reprieves, or, upon advice from the Senate, pardons, except in cases of impeachment.
In cases of removal from Office, by death, disability, disqualification, impeachment, resignation or other reason, the position shall devolve to the Vice President until such vacancy be filled, whether by return of the President or Election of a new President. If, during the vacancy of the office of President, the Vice President shall be impeached, displaced, resign, die, or be absent from the Republic of North Dakota, the president of the House of Representatives shall act as President, until the vacancy be filled. Whenever the Office of President or Vice President shall become vacant, the one exercising the Position of President shall hold a special Election to fill the vacancy;
The President of the Republic of North Dakota shall have the power to issue writs of Election to fill Vacancies in either House;
The President of the Republic of North Dakota shall have the power to commission officers and other personnel needful for maintaining continuity in training and superintending militia members and for the upkeep of public equipment necessary to provide for common defense;
The President shall have the power, upon the direction of the Legislature, to call for the assembly of the militia of a county, or several counties, and shall coordinate their action in the event of eminent attack or insurrection by providing information and advice, but shall not have the power to issue orders of command, which shall be reserved to county commanders and their volunteers; but shall, in no event, call the militia for use against anyone who is engaged in peaceful activity, nor to suppress a revolt against political power by passive resistance; but shall reserve the militia to suppress, with reasonable force, violent insurrections upon the peace and tranquility of any community within the Republic of North Dakota;
The President of the Republic of North Dakota shall keep a journal, day by day, and shall, from time to time, publish the same in congruent manner to that of both Houses.

Oath of Office to the Republic of North Dakota shall be taken in the presence of two witnesses within ten days prior to taking Office.
The Oath of Office shall read “I do solemnly affirm that I will uphold the Constitution for the united States of America and the Constitution for the Republic of North Dakota and will, to the best of my ability, faithfully execute the office to which I have been duly elected, in accordance to the laws of the Republic of North Dakota, so help me God.” It shall then be autographed by the one taking the Oath, then by two other living People, then stamped with the Great Seal of the Republic of North Dakota and filed into the Records by Republic Recorder, and shall be Recorded within the Journal of that Office and published at the next regular interval.

Article Three:

Judicial

Section One: All judicial Power herein granted shall be vested in a Supreme Court of the Republic of North Dakota, and to Appellate and Trial courts the Congress of the Republic of North Dakota shall establish, who shall weigh all cases brought before them in congruence with the Constitution for the Republic of North Dakota and that of the united States of America. If any lower court decision is in want for either, they shall correct the error of the lower court: and by application of affiant, shall have review powers over private courts for abuse of process and denial of due process of law. All Cases involving Private People shall be judged under the common law,
Section Two: The Supreme Court of the Republic of North Dakota shall have seven Justices, who shall hold their office for the term of seven Years. They shall be nominated by the President of the Republic by advice and consent of three-fourths of the House of Representatives, the nominee will be appointed. They shall receive an adequate compensation, which shall not be diminished during their continuance in office with good behavior. But they shall receive no fees or perquisites of office, nor simultaneously hold any other office within any other branch of the Republic of North Dakota. The first group of Justices appointed shall be divided, and three of them, chosen, two by the Senate and one by the House of Representatives, shall serve a four year term, then be replaced. No Justice may be immediately re-appointed, but may seek re-appointment after two years,
Section Three: No North Dakotan shall be eligible to be appointed to the Supreme Court of the Republic of North Dakota who has not attained the age of thirty-five years. Said Candidate, at the time of Appointment must have been domiciled inside the borders of the Republic at least seven Years and shall not have been a member of the State of North Dakota government or held any legal or issued license or other permit to practice law within the prior ten years. Vacating the seat in Republic of North Dakota more than twenty-one days without unanimous consent of the remaining Justices of the Supreme Court shall be construed Vacation of Office. Once Appointed, the Oath of Office shall be taken not more than ten days prior to taking Office,
Section Four: There shall be a constitutional comprehension test given to any Candidate to be appointed to this position. Said Candidate must prove in this test, a comprehension of the rules of common law and equity, and a fluent understanding of not only this constitution, but the other Founding Papers of the united States of America, against which all Cases brought before the Supreme Court of the Republic of North Dakota must be held in continuity. Failure to pass is disqualification from the immediate Appointment. A second test shall be administered not less than three Years after the first, if the Candidate is again considered. A second failed test is a permanent bar from Appointment to the Supreme Court,
Section Five: The Supreme Court shall appoint its own clerks,
Section Six: The creation of private courts shall be encouraged, but not funded by the Republic of North Dakota. Such courts shall be conducted in congruence with this Constitution and that of united States of America, and Judges in such courts are encouraged to take and pass the same test as though they were being appointed to the Supreme Court of the Republic of North Dakota,
Section Seven: Restitution for crimes and punitive damages shall only accrue to the People affected, and only those whose names are wet-ink signed to a debt shall be responsible therefor. No other may be pursued for the same debt,
Section Eight: Claims for Writ of Prohibition or Order of Restraint may be requested by the People if there is probable cause wherein there is prove-able intent to commit a crime, but no injury is alleged or there is expressed intent to commit a crime followed by no act. Upon reasonable grounds, and with sufficient securities, the People may obtain restraining orders and other extra-ordinary remedies.
If any Justice of the Supreme Court of the Republic of North Dakota shall be unable to perform their duties due to disability, corruption, or abuse of power, the President shall have the power to remove them, with consent of two-thirds of each House. The reasons for removal, and the names of those who assent and dissent to the removal, shall be entered into the journal of both Houses and that of the President of the Republic of North Dakota. Any vacancy in the Supreme Court of the Republic of North Dakota shall be filled by the President of the Republic of North Dakota in the usual manner.
The Supreme Court of the Republic of North Dakota shall keep a journal of its day to day works, and shall publish in the same manner as that of the other branches of government,
The Supreme Court of the Republic of North Dakota shall appoint one Justice who shall serve as Chief Justice. This Chief Justice shall serve as presiding Judge over any controversy involving the Office of the President or Vice President of the Republic of North Dakota,
There shall never be a license or permit required to practice law, whether as a Justice in a court room or in prosecution of accused or defense of a victim; but any liability for damages due to negligence shall accrue upon the one who professed ability without knowledge,
The Oath of an Appointed Justice to the Supreme Court of the Republic of North Dakota shall be taken within ten days prior to taking Office and shall read “On my living honor, I pledge to fulfill the Office of Justice of the Supreme Court of the Republic of North Dakota to the best of my ability, and to judge all Cases before me with complete impartiality; to recuse myself if I am unable to do so, and to hold myself and those in this, the Supreme Court of the Republic of North Dakota, within the bounds as established by the Constitution of the Republic of North Dakota and the Constitution of the united States of America upon which it rests, so help me, God.”

Article Four:

General Office Rules

Section One: The location of the Seat of the Republic governance shall be Bismarck, or at other such place as prescribed by law, and shall contain all Republic Offices as needed by Congress, the President and Vice President and the Supreme Court of the Republic of North Dakota with all associated Offices. The doors to all government Offices shall be open to the People during normal business times.
No candidate eligible to Election to any position within the Republic of North Dakota shall be allowed to enter their name upon the ballot for election until a bond has been posted of sufficient value to assess for damages if any should occur while in their elected Office. Such bond shall not be financed by an insurance agency, nor shall it be financed by the Republic of North Dakota through any means. Such bond shall be provided by the candidate, and shall not be provided or insured by the Republic of North Dakota.
No Member of any branch of government in the Republic of North Dakota, while in Office for one position, shall hold any Office other than that to which they have been elected or appointed.
Any request for salary raise for Elected positions with the Republic of North Dakota shall be put to the People, to be voted upon by ballots, cast in the usual Elections, and, if passed, shall take effect in the next cycle.
No Member of any branch of government in the Republic of North Dakota shall possess, obtain or maintain any title of honor or Marque, foreign or domestic, and upon acquiring such, shall be disqualified from obtaining or maintaining any office within the Republic of North Dakota.
Pursuant to the requirement that Journals be kept by all three branches of Republic leadership, as with any matter of public record, any and all matters of public record may be reproduced and must be reproduced on lawful demand. This shall also apply to the State of North Dakota.
Executive Session shall only extend to such meetings as required to strategize for Defense of the Republic of North Dakota, or to allow those in-trusted with an issue, reasonable time to form a response to propose to the People. Such Sessions shall not become common-place, as issues concerning the People require input from the People to affect an agreeable response.
Constitutional competency tests of appropriate positional graduations shall be created by the Congress and shall be administered to all People seeking any Elected or Appointed position within the Republic. Such tests are encouraged to be given to all those in any position, public or private, but shall not be required unless seeking election or Appointment.
Votes and/or proposed amendments on all bills or acts, for or against, shall be published by roll call in all local newspapers, and by other reasonable communication methods throughout the Republic for transparency of Office, as well as being published in the Journals of the respective Houses and of Office of the President of the Republic of North Dakota.
No law, act, bill, or order shall be passed that shall abridge or infringe any right of the People. No decision shall be passed by any court which shall abridge or infringe the right of the People without due process of law concerning each of the individual People affected thereby; and no such ruling shall be lawful, which does not state when the affected right shall be restored to the concerned People.
No thing proposed as a law shall be such unless it states a right to be protected, a way in which that right shall be protected and a penalty for infringement or revocation of the right.
Fitness for any Office shall be determined, after basic qualifications, by merit of experience and record.
All Oaths of Office shall be taken in presence the of two witnesses within ten days prior to taking Office.

Article Five:

Disqualifications

The following shall be considered as general disqualification from holding any office in the Republic of North Dakota; or to be removed from the position within the Republic, without regard to the position, whether within Republic or within a township, city, or county:

A: Being convicted by a jury or grand jury of one's peers of a felony crime wherein there is a physical victim: or,
B: Holding a position of trust or fealty which is at odds with the Republic of North Dakota or the Republic way of life: or,
C: Having been an attorney, or being a member of the B.A.R. association of any State or country within the previous ten Years: or,
D: Being a member of any organization which requires one to take an oath which may be at odds with the Republic of North Dakota: or,
E: Any one who has refused to take the Oath to the Republic of North Dakota, or failed to take the Oath to the same, or any one who should break their Oath to the Republic of North Dakota, or failed to take the Oath within the specified time for the elected Position: or,
F: Any who shall possess, obtain, acquire before or while in office, any title of nobility or honor, or shall, without the recorded consent of the Congress, accept and retain any present, pension, office, compensation or recompense, of any kind whatever, from any king, prince, or foreign power, they shall be deemed unfit for any office within the Republic of North Dakota, and shall no longer be considered a North Dakotan.
G: If the government of the United States of America shall refuse to provide security at any of its borders against foreign invasions of criminals or armies in contravention to the Constitution of the united States of America, the Republic of North Dakota may take any measure for its own security or to reinforce the security of any other State or Republic within the union as necessary: and if any member or members of the government of the Republic of North Dakota shall refuse to provide security at any of its borders against foreign invasions of criminals or armies in contravention to the Constitution of the Republic of North Dakota, the same shall be removed from Office under charge of Treason and dealt with in accordance with applicable Law.
H: Anyone elected or appointed to any position within the borders of the Republic of North Dakota who shall foment, construct or condone, intentionally or otherwise, any act against the People of the Republic of North Dakota shall be dismissed from Office immediately and dealt with in accordance to applicable law,
I: Anyone elected or appointed to any position within the borders of the Republic of North Dakota who fail to repel a wrong when possible occasion it and shall be liable to the full extent of the law.

Article Six:

Slavery:

No form of slavery shall be committed or tolerated in the Republic of North Dakota. The right to be made whole shall not extend to permanent servitude of any man or woman, nor shall any of the People be deprived of any right indefinitely. No right of the People may be suspended without an expected date for its return.
No form of slavery by contract, such as licenses, permits or any other form of unlawful contract shall have a binding effect on the People, nor shall any contract be lawful within the Republic of North Dakota without the following parts: Parties competent to contract, free and genuine consent, full disclosure in detail, sufficient mutual consideration, certainty of terms, meeting of the minds, signatures or autographs of all parties at time of signing, and privity of contract. Lacking any of the aforementioned parts, it is a nullity.
All political power is inherent in the People, without which there would be no value given to any man-made thing. As Sovereign political power holders, creators of both this Constitution and the Constitution of the united States of America, no government created by man shall have the authority to convert the People into persons of any kind for any reason whatever. Such act shall constitute Treason and be punishable according to law.
No legislation or other authority may be passed which inhibits directly, or by extension, the Rights of the People.
No contrivance of man shall possess authority over living People, nor shall it have any rights to possess any thing which may be owned by the People.
Once a US citizen becomes part of the Republic of North Dakota (North Dakotan), they shall have the lawful right and ability to be removed from any contracts en-slaving them from the State of North Dakota, United States Inc, and any other entities which are en-slaving said North Dakotan in accordance with this Constitution.
Those who have been indicted and convicted, in a manner in accord with the law, by a jury of their peers, may be required to pay restitution, vis reasonable monies or labor to the victim, but such bindings shall not be inhumane or excessive: neither physically, nor mentally.
Honest work is a much better behavior modifier than is punishment; and where there is an injury to either one of the people, or to all equally, the fruits of a convict’s labor will be greater if they be treated with due dignity; upon release into society they will be more valuable and better for the lesson. Jail terms shall be reserved for those who cannot be released to restitution work indenture due to public safety concerns or flight risk.
Any permanent loss or deprivation of any Right of a North Dakotan must be a knowing, intentional and fully-disclosed act based upon lawful reason. Must be attested to upon an affidavit by two living souls with full knowledge and disclosure of reason, and must bear their wet-ink autographs to their full knowledge and acceptance of the terms of said loss or deprivation. In case of mental illness or other deficiency, there must be a signatory designated for the one affected, and said designee may not be one of those who autographed the affidavit.
This slavery Article shall extend to the areas of taxation of the People and to money-handling for those with special needs. No form of taxation shall be lawful within the Republic of North Dakota that shall impair the normal, day-to-day ability of the People to live their lives in an ordinary manner; nor shall the control of monies by those entrusted to administer for those unable to do so for themselves be handled is such a way as to impair their normal and safe day-to-day living.
Any violation of this Article shall incur not less than three years restitution and one thousand dollars in fines. A second violation shall be seven years restitution and five thousand dollars in fines. All fines levied on anyone in a position within the Republic of North Dakota shall be split in half between the Republic Treasury and the affected People. If the fine be levied against one of the People, the money shall be due to those affected by the contract.
This Constitution is not written to enumerate or disparage the Rights of the People, but to form the government and frame its powers according to those needs.
The People of the Republic of North Dakota shall be under Republic law at all times, no matter where they are in the world and shall not be subject to any other form of law.
No form of penalty shall be placed upon the People of the Republic of North Dakota for private use of any conveyance upon the post roads or public highways.

Article Seven:

Education

Section I: Education, being necessary to the free People of the Republic of North Dakota shall be forever encouraged, regardless of form, but shall not be provided or funded by the Republic, nor shall it be made compulsory, for both are repugnant to both common law and freedom.
The Counties and Townships shall have the Right to create such schools as their inhabitants deem most efficient to their needs, but there shall be certain minimum Standards set in place for such public school venues:
A. In addition to the basics of reading, grammar, spelling, phonics, arithmetic, science, physiology, true and factual and history, there will be a Constitution-based course. This course will focus in parts, on the writing of the Constitution of the united States of America as well as this Constitution, the associated Bills of Rights, the Treaties, Declarations of Independence and other relevant historical information.
B. All current curriculum with added bias and lack of fact shall not be allowed and must be removed if currently present. The complete leadership of each county, city or township must concur jointly with the People, and their community school curriculum must be based only on educational needs while meeting the basic standards listed. At no time shall any curriculum promoting being dissatisfied with one's body in any way be allowed in any school within the Republic of North Dakota.
C: It must be considered when athletics or extra-curricular sports are discussed, it shall be based on biological nature. No bias opinion or emotion may be considered. This too shall be a jointly agreed issue with the leadership of each county, city or township with the People affected.

Article Eight:

Election

With a decent respect to the People of the Republic of North Dakota to have their voices heard in their elections, locally, as well as throughout the Republic and nationally, certain rules must be in place to ensure those voicing their opinions live within the Republic of North Dakota and have the right to be concerned with the results of those elections.
All buildings designated by any precinct, township, city or county for use for election purposes shall be open and manned in accordance with applicable laws, at all election cycles, for any issues whatsoever, which shall be brought before the People. There shall be at least one building designated for every township within each county of the Republic of North Dakota.
Some proof of identity and possession of lawful Right to vote within the Republic of North Dakota shall be required. No limit shall be placed on what the identification can be: so long as the facts presented thereon can be proven before a ballot is cast or voting is allowed, it shall be accepted.
No prior registration shall be required; though locally, a compiled list of People lawfully allowed to vote in a precinct, township or county may be maintained if the People domiciled therein choose to do so but it shall not be mandatory to be on the list to vote.
Voting shall never be compulsory, as this is repugnant to a free People. However, silence is acquiescence to the voted position of the People in any matter, as the silent party chose not to exercise their voice.
Voting shall be done by physical presence in the precinct with proof of eligibility in hand, except in proven cases wherein the voter cannot be present. In such cases, a paper ballot may be issued, brought to the voter, filled out in privacy, sealed in the usual manner, and delivered to the precinct by the one presenting the ballot to the voter. A position afforded this duty may be created by any precinct, township, or county, however shall not be funded by the Republic.
Ballots shall not be openly mailed en mass to the People, nor will machines capable of being connected to any internet or intranet, by wire or wireless, be allowed in any voting precinct within the Republic of North Dakota.
Any compiled list of voters within the Republic of North Dakota shall be purged prior to the start of every election cycle.
Without exception, the results of every election shall be certified by the collecting authority initially, and again by the Republic Recorder upon receipt.
In congruence with the Constitution of the united States of America, this Republic may not disallow any eligible Candidate for federal Election from any ballot cast herein.

Article Nine:

Taxation

Taxation shall be limited as follows: one percent flat tax on Gross Daily Product value of raw products grown or produced within the Republic of North Dakota, collected at time of sale, a five percent tax on non-essential items purchased within the Republic, to be defined later, a five cent per gallon tax on road fuels to be spent on highways and bridges maintained under the responsibility of the Republic of North Dakota.
The following shall not be taxed: private conveyances, private business and equipment used in private business, private wages, private land and homes, food, water or medication.
The following items shall be taxed when purchased within the Republic of North Dakota, the amount not to exceed five percent: Alcohol, tobacco, recreational conveyances such as motorhomes or coaches, boats, sporting goods (other than guns and ammo), archery, sport hunting items, all-terrain vehicles, snowmobiles.
Goods such as non-essential items or products originating within the borders of or passing through the Republic of North Dakota by any means of transportation by any commercial business shall be subject to a tax not exceeding five percent of value.
No foundation, public or private, or other entity shall be allowed to donate funds to any Sector of the Republic of North Dakota wherein any of its members sit on any board of Supervision, or maintain interest, controlling or otherwise. No extra-ordinary donations may be made to any campaign by any source for any reason.
Once land or other property is purchased in a lawful manner and the value thereof has been paid, no tax debt may be levied against such land or property for any reason.
Any bond or levy requested by any township, city, county, or by the Republic of North Dakota shall be limited to a term of two years and shall have been paid in full with recorded proof before another may requested.
Any monies or bonds requests shall fit neatly on eight-and-a-half by eleven inch piece of paper in twelve-point Times New Roman or reasonable equivalent and shall concern one particular and specific purpose. Attachments may be made thereto to break down individual item cost of the proposed project, but shall be considered as a whole when being proposed to the People.

Article Ten

Republic Positions:

The governing body of this Republic shall not create, or allow to be created within its borders, any sector or position which shall obtain, usurp or otherwise be endowed with direct control over the People of the Republic of North Dakota. The People are of Right and ought to be free to live their lives in accordance with their choices, provided they do not trespass upon the free-will Rights of others, in line with respect to their Life, Liberty, and pursuit of happiness.
All positions listed below shall be voted on by general ballot by the People of the Republic of North Dakota and any serving in these positions may be removed by demands from fifty-one percent of the People who voted for that position. If such number is reached, the position shall be vacated immediately and special Election of a replacement shall commence. The person removed from that position shall be in-eligible to immediate re-election, and, depending upon the cause for removal, shall be permanently barred from public service within the Republic of North Dakota.
The qualifications for these positions shall be congruent with standard minimums for other elected positions within the Republic.

Republic Secretary: Elected, 3 years, The Secretary of the Republic of North Dakota shall be tasked with administering Oaths of Office to newly Elected Officials within the Republic and shall maintain the records thereof indefinitely. Said Oaths of Office shall be administered to the newly Elected Officials within ten days of taking Office, Sundays excepted.
The Secretary shall also keep the Republic voting records, the tallies of which shall be made available to the People of the Republic of North Dakota at will. The matter of which name voted for which candidate is a private matter, but the counted tally of votes for each candidate is not and will be open public information. To record the meeting minutes of all formal meetings, to take and pass on messages for the President and Vice President, to attend to any business matters within the Republic governance not requiring posting to public communications, to accurately pass on to the Communications Secretary any information to be made public. May substitute for a short time as Communications Secretary as needed.

Communications Secretary: Elected, 3 years, To handle all communications with the public such as emails, radio advertisements, social media posts and advertising, and other duties as necessary.

Republic Health Certifier: To work with the public to obtain expected health and safety standards, facilitate the dispersal of these expectations and standards to the county level and to maintain a list of places currently meeting those standards. This power shall not extend to enforcing any standards through any other method than withholding the certificate of compliance. At no time shall the presence or lack thereof of this certificate become an impediment to the People's right to engage in private business in accordance with Article VI of this Constitution.

Tribal Liaison: Elected, 6 Years, The Republic of North Dakota has many Tribal Lands. With this comes the expectation of variance in the manners in which we deal with crime as opposed to the Reservations. The Candidate for this position should be well versed in Native customs as well as our own with the ability fluently translate between the two. Something we might disregard as off-hand may be an utter insult to them and vice-versa. In order to achieve the honor and dignity our predecessors failed to, we should be able to make and keep our own laws and treaties with them in accord with the laws and treaties superseding them, provided those are in lawful honor.

Senior Roughrider: Merit Appointed, 6 years, To oversee and train new Roughriders for their Post. To oversee corruption that extends beyond the border of a single county, or to investigate any corruption of higher than a county Official, To help set and refine training standards so the handling of all Roughrider matters is uniform and those with questions can get answers.

Representative: Elected, 4 Years, To write laws, bill and acts. To ascertain that no law, bill or act shall pass through their House, which should affect the People, which does not state a right to be protected, a manner in which it shall be protected and a penalty should that right be infringed. No Representative shall pass or propose any piece of legislation removing or infringing on the rights of the People. Such a blatant attack on the People shall be considered Treason and shall be punishable by immediate removal from Office and Indictment by Grand Jury and prosecution to fullest extent of applicable law.

Senator: Elected, 6 years, To write laws, bill and acts. To ascertain that no law, bill or act shall pass through their House, which should affect the People, which does not state a right to be protected, a manner In which it shall be protected and a penalty should that right be infringed. No Representative shall pass or propose any piece of legislation removing or infringing on the rights of the People. Such a blatant attack on the People shall be considered Treason and shall be punishable by immediate removal from Office and Indictment by Grand Jury and prosecution to fullest extent of applicable law.

Supreme Court Justice: Appointed, 7 Years, To judge all cases brought before them in the strictest conformity with the Constitution for the Republic of North Dakota, the Constitution for the united States of America, the Northwest Ordinance, the Articles of Confederation, the Lee Resolution, the Declarations of Independence, both 1776 and 2020, along with all applicable International Laws and Treaties. Their decisions as an Article III Court to this Constitution cannot be challenged in any other court within the Republic, nor can their recording of a Jury decision on the record be challenged in any other court within the United States.

Supreme Court Chief Justice: There shall be one Justice in the Supreme Court of the Republic of North Dakota appointed from within who shall have the authority to preside in cases involving the President of North Dakota. They may also preside over cases of alleged corruption within the lower courts, however, the Chief Justice must refer the case to a higher court in cases of conflict of interest.

Republic Recorder: Elected, 4 years, To record anything brought to the Republic Recorder's Office to be a matter of public Record. Smile and file. To record the results of all elections in all precincts, townships, cities, counties, Republic or national. Electronic records to be kept permanently on a private, non-integrated server and reproduced in full and upon request by anyone having lawful reason to access such records. Shall reproduce any record for any item filed with the Office upon lawful demand.

Republic Treasurer: Elected, 4 years, The Treasurer shall disperse funds from the Republic Treasury in accordance with the Bills passed by the Congress, and by no other source. If some branch needs money, they shall go to the Congress to petition for it, but the explanation given to the Congress for the use of the money shall fit on one eight-and-a-half by eleven-inch piece of paper in the same manner as any Bill passed by the Congress, and must be unambiguous in its text. The petition for money must state exactly the amount needed, the receiver of the funds and what the money is to be used for. Such petitions for monies from the Treasury of the Republic of North Dakota shall be entered into the Journals normally kept and shall also be published at the next interval for Journal publishing. Shall also maintain standing balances to all accounts at all times and advise the necessary sectors of any funding issues. There shall be no minimum or maximum amount of money in any Republic account, nor shall there remain permanently stagnant funds in any account. Upon lawful request, the Republic Treasurer shall furnish the balance of any Republic of North Dakota account requested. No check shall be written from a Republic of North Dakota account without the signature of the Republic Treasurer and that of the head of the requesting Sector.

Deputy Republic Treasurer: Appointed, 2 years, Assist with the daily running of Treasury business as needed. Shall be responsible to verify accuracy and completeness of any treasury requests before they are presented to the Republic Treasurer to make checks. Shall temporarily serve in place of the Treasurer as needed in the event of devolution of command until a replacement can be selected by special election of the People.

Republic Auditor: (4 positions) Elected 6 years (alternating) The Republic Auditor shall be tasked with auditing the Republic Treasury account(s); there must be an appropriation of all monies removed from or credited to the treasury. General information shall be made public upon demand, but more specific information may be obtained by direction of the Supreme Court of North Dakota, or by signed affidavit from the People of at least three counties, cities, or townships within the area affected by the complaint listed on the affidavit. Failure to commence and report an audit when requested and within a timely manner shall be cause for disciplinary action up to and including removal from Office. May initiate formal inquiries for unexplained and unapproved expenses of any kind from any sector whatever. May cross check or be requested to cross check another Auditor's work. The Auditor shall have external supervisory capacity if petitioned by the People of a county, city, or township, to look at alleged corruption or mismanagement of funds, but shall in no case, have any access nor prosecutorial capacity against any Official if corruption is found. The report shall be made the People of the affected area and the People of that area shall deal with that corruption in accordance with the law.

Republic Foreign Ambassador: Merit Appointed, 6 years, Allowed recommendations from Executive branch, and must pass competency tests for Constitution of Republic of North Dakota, the Constitution for the united States of America. Shall handle all issues with foreign powers including the State of North Dakota and sub-corporations. Must take Oath of Office to Republic of North Dakota.

Republic Education Secretary: Elected 6 years, Shall create and maintain educational information on the Republic way of life in terms of governance as well as private life. Shall inform of the contrasts between democratic ideals and those of the Republic in terms of the manners of individual freedoms available to those who choose to live and let live, provided the exercise of the Right of one do not extend so far as to intrude the equal expectation of another to the same Right. This position shall work to educate all those willing to learn about the Republic regardless of location, and encourage open and equal private freedom to all.

Republic Chaplain: Appointed, 4 years, To administer any last rites as required. Shall perform these rites as a non-denominational spiritual counselor. May visit homes, jails, hospitals and other infirmaries as needed or requested.

County Positions

Sheriff: Elected, 6 years, Enforcement of Laws, public disputes, general crime handling.

Deputy Sheriff: Elected, 4 years, Cannot campaign together. Same duties as Sheriff. May serve as necessary in devolution of command.

Coroner: Elected, 4 years, Removal of dead human bodies from crime scenes, homes and accident scenes

County Auditor: Elected, 6 years, Must oversee, record and certify each election held within the county. Shall reject any ballots not appropriately autographed, dated and sealed without fail or recourse. Shall also acquire names for, maintain and purge any electorate roll said county should choose to maintain.

County Secretary: Elected, 4 years, To record minutes for all formal meetings and make those records available upon lawful demand from the People. May also be requested to record anything brought before them into the county records for any reason. Smile and file. May also be requested to notarize. Nothing notarized gives jurisdiction to the County or to the Republic.

County Treasurer: To verify the lawful request for and to write the checks as needed for the county. May also audit or request the Republic Accounts Auditor if there are inconsistencies suspected or found. Must submit to any audit requested by the People of the county.

County Health Certifier: Appointed, 6 years To certify that any public place requesting certification can be certified as healthy. Cannot fine, simply withhold certificate until compliance. Manner and matters of certification must be uniform.

County Notary: Appointed, 4 years, County paid witness. Nothing notarized gives jurisdiction to the County or to the Republic. May have more than one as deemed necessary by the county.

Roughrider: Elected, 6 years, Has ultimate investigation capabilities, aside of the People. Any suspected or reported corruption shall be investigated to its fullest and prosecuted in accordance with all applicable laws or treaties, foreign or domestic. Any findings shall be brought before the People who shall call a Grand Jury to indict and prosecute. The same Jury shall not sit for both the indictment and prosecution. The Powers thus extended to the Roughrider are independent of the Sheriff, but subordinate to the People.

Judge: Elected, 6 years, staggered, Shall hear the verdict of the Jury, write the verdict down and sign in attest to the words written thereon as having been the spoken verdict of the Jury. Shall have no direct authority in the case, the jury selection, or any other manner of the trial aside of keeping order and certifying the opinion of the jury.

Representative (outside of Republic duties): Shall listen to the concerns of the People of their County of election and present those issues and opinions as necessary in Session of the House of Representatives, or when in Session of both Houses as needed. Shall also seat and confirm those elected to Office within the Representatives' county of Election.

Senator (outside of Republic duties): Shall listen to the concerns of the People of their County of election and present those issues and opinions as necessary in Session of the Senate, or when in Session of both Houses as needed. Shall also provide for immediate Special election as needed for positions within their county of election what shall become vacated due to illness, death or for other lawful reason to vacate.

City and Township shall choose their own positions, but these positions shall be bound by the Constitution of the Republic of North Dakota and the Constitution of the United States of America.

Priority Statements

It has become exceedingly apparent to the People of the Republic of North Dakota that clarity of the rights, powers and duties of the People of this Republic have been discarded, ignored and utterly obliterated through a form of government in this land, once known as The State of North Dakota, a private, for-profit corporation, which has sought to return its creators, the People, to the same utter despotism and slavery our ancestors left Great Britain and those lands under its control to escape from. That form, so-called Justice, has engaged in tyrannical behaviors at every turn; taxing the People which might not otherwise be taxed with fines levied through rules, codes, statutes and ordinances imposed by ex post facto agencies and laws, which are forbidden and foreign to the Constitution for the united States of America as Supreme Law of this land: and with which all laws in this land must harmonize.
This Bill of Rights is written to help clarify those past mistakes and to help ensure they do not happen again inasmuch as we are able. These protected rights can in no way enumerate or disparage any right not specifically listed. It is also important to note here that, though through free-will endowed to us from our Almighty Creator we have unlimited unalienable rights; with the exercise of those rights comes the in-separable responsibilities for what ever may result from those exercised Rights, planned or not. It is through this level of gravity and respect for ourselves and our fellow man that we must view the incredible responsibility known as true freedom. We expect our rights respected, and in return, we shall give the same. The exercise of Rights can only be limited where the invasion of anothers' equal and reasonable exercise of the same Right would be infringed.
What is written in this Bill of Rights is not so much for the People, but to remind government, whatever its form, that these rights are off limits to government intrusion without due process of common Law, that which is common to all mankind, wherein a signed, witnessed affidavit must be presented showing the evidence and specific physical victims created by the action named in the affidavit. Lack of this evidence in hand is cause for immediate dismissal and action against the original affiant from the accused.
We the People living on the land known as the Republic of North Dakota shall be known as North Dakotans.

Political Power:

All political power is inherent in the People, without whom there would be no value given to any man-made thing. All People, who remain the Sovereign recipients of the rights and responsibilities as granted by Nature's God, have granted certain limited Powers to those in-trusted to govern Common matters. All rights of the People shall remain forever in-violate. The People shall forever be guaranteed a Republic form of government.

Right I:

It shall be guaranteed to all People living inside this Republic the right of free speech, and of free press, wherein they may speak, write and publish their peace. In all trials for libel, the truth shall be produced in evidence and shall be a sufficient defense when the matter is published with good motive or justifiable end. The jury shall have the same power of giving a general verdict as in other cases, and in all indictments or sworn affidavits for libel cases, the jury shall have the right to determine the facts and guilt in accordance with the law.

Right II:

It shall be guaranteed to all People living in the Republic the right to be free to exercise their own religious choice in their home and shall be forever free to gather for the same reason, but the practice of this right shall not be so construed as to excuse acts of licentiousness, or to interfere with the peace, safety and security of the Republic. No form of discrimination or preference shall be exercised when considered for petit or grand jury, or for Jural Assembly, or for such reasons as Common Service.

Right III:

It shall be guaranteed to all People living inside this Republic by inherent right that they may peaceably gather together for the common good, and to petition for redress of Common grievances, or for other purposes as they deem necessary to address the common good, or to stand in unity to protest a perceived wrong, being fully responsible for the choice to exercise the right. Protection of this right shall not extend to any who become a public nuisance or to allow for damage to common or private property, including businesses, post roads or Common use roadways. This right shall not be suspended.


Right IV:

The right to writ of habeus corpus shall not be suspended excepting cases of rebellion or invasion when the Republic safety may require it. Any Lawful writ or affidavit may be used when appropriate and must be considered at face value in a court of competent jurisdiction. Any affidavit or writ submitted to a Common Office must be recorded, whatever its form, and shall only require two witnesses to autograph as a testament to the facts presented thereon.

Right V:

All North Dakotans have the right to engage in private business and to engage in private economic dealings without undue interference. In the previous system, having a license for the given business profession was wrongfully considered to be the only way of knowing the business was qualified to do a thing to a certain set of standards. Since the Republic can not license a thing or practice it does not own, it remains with the owner of the private business to create a Testament to his own knowledge and qualifications to the type of work he seeks, preferably signed by those he has satisfactorily worked for. This is highly encouraged in the absence of an enforced set of standards.

Right VI:

It shall be forever guaranteed to all People living in this Republic the right to keep and bear arms, without regard to the nature of those arms. Suspension, interference in, or abolition of this right against any inhabitant without due process, shall constitute treason.

Right VII:

It shall forever be guaranteed to the People the right to a Jural Assembly. This shall be a jury of the People, not subject to the constraints of the Judicial Article in the Constitution for the Republic of North Dakota. It shall be a separate entity to be used only by the People in Judicial corruption cases where a true and honest outcome can be achieved in no other way.

Right VIII:

All North Dakotans shall be forever guaranteed the freedom of trial by a jury or by grand jury of their peers and may request one in any case against them whose sum total is $20 in silver or more, even if not ordinarily required. No man shall, in case of felony, be proceeded against by other than indictment, except in cases arising out of armed forces, or in the militia when in actual service in time of war or Common danger. In all other cases, offenses shall be prosecuted by indictment or sworn affidavit. The right to a jury trial or grand jury trial shall remain in full effect. In a criminal trial, neither the accused nor their immediate family shall be compelled to testify, but may choose to do so, nor shall any be compelled to testify for or against the accused; and such testimony given shall be voluntary.

Right IX:

The Accused, in any case, shall have a right to counsel of willing participants of their choice who have a fiduciary duty to the Accused, the minimum of which is as a good Samaritan if unpaid for services, to full liability to the Accused resulting from incompetence, or from abuse of said fiduciary duties.

Right X

All North Dakotans shall be able to post bail with sufficient sureties for any case against them, except for capital offenses when proof is evident or the presumption great. Excessive bail shall not be required, nor excessive fines imposed, nor shall cruel or unusual punishments be inflicted. No man shall be unreasonably detained, nor cause to be detained, nor shall he be confined in any room where criminals are actually in-prisoned. No man shall be in-prisoned for any cause where there is no physical victim, property or bodily damage.

Right XI:

All competent People living in the Republic of North Dakota have the right to contract or refuse to contract at will. In private matters or in Common matters, this right shall remain in-violate and any rules which govern each type of contract shall remain in full force. The People shall also have the right to rescind any contract not fulfilled according to the terms or to rescind their autograph from any contract in which the full terms and conditions were not fully dis-closed.

Right XII:

All North Dakotans have the right to seek any type medical help they choose; and to be free from forced vaccination or medication; and to institute among themselves, for private, or for common use, such pools of funds as they deem necessary to pay for such expenses. Contributions to the said pools of funds shall not be compulsory, nor shall the Republic of North Dakota be a contributor.

Right XIII:

All inhabitants in the Republic of North Dakota have the right to purchase or obtain by other lawful means, private property in North Dakota without encumbrance beyond the terms of applicable contract, not to exceed seven years' indenture, such as automobiles or other means of conveyance, livestock, private businesses, lands, homes, furnishings or any other thing they may lawfully acquire. With these private holdings comes the expectation of privacy in their usage or contents, provided no use shall infringe on the equal rights of others to peace and safety.

Right XIV:

The right to be safe in ones' home against intruders shall be forever in-violate. This may be defended, upon threat of force from the intruder, by Right VI.

Right XV:

The right of the People to be secure in their persons, houses, papers and effects, against unreasonable searches and seizures, shall not be violated, and no war-rants shall issue, but upon probable cause, supported by Oath or affirmation, and specifically describing the place to be searched, and the persons or things to be seized. This war-rant must either be in-hand or the evidence present be so great that said war-rant is assured. Failure to successfully obtain said war-rant, or to present such upon demand if in-hand shall constitute a violation of Oath of Office and those executing said war-rant shall be privately liable for the unreasonable intrusion. Orders given shall not be sufficient defense for unwarranted searches.

Right XVI:

All forms of slavery are forbidden in the Republic of North Dakota. Other than for a capital offense, no inhabitant shall be indentured to any contract whose term exceeds seven years, nor shall any inhabitant in servitude as restitution be indentured for a term of greater than seven years.

Right XVII:

The right to free travel upon common use roads or post roads and upon the public highways for inter-state use by the inhabitants of the Republic of North Dakota shall not be prohibited nor infringed upon. All People not engaged in commerce have the right to travel these roads in their private conveyances in a safe manner with respect to the common rights of others, and to do so without undue interference.

Right XVIII:

The right to reasonable privacy in communication of any form shall be guaranteed to all North Dakotans.

Right XIX:

There shall only be common law used in the Republic of North Dakota. No civil law has any affect on one not commissioned to a Common Office position and only applies during time on the “clock” in said position.

Right XX:

No Bill of Attainder or ex post facto law shall ever be passed, nor shall any law be passed which inhibits the obligations of a contract.

Right XXI:

None shall be convicted of Treason unless on testimony of two or more witnesses to the same overt act.

Right XXII:

Acts of the Legislature, which by incorrect application, violate a right secured or a prohibition imposed by the Constitution of the Republic of North Dakota or any of the Foundational documents mentioned therein are void by such application. Anyone aggrieved by the act of a public Official or Officer who incorrectly applies an act of the Legislature causing a violation of the rights herein secured shall have the right to present such claim to a Grand Jury; and upon the finding of guilt on the part of the Officer or Official, the claimant shall the right to reasonable damages to be paid from the bond sureties of said Official or Officer.

Right XXIII:

At no time shall eminent domain be allowed in the Republic of North Dakota. All land required for any purpose must be acquired from People willing to sell and must be purchased at fair market value. If either of the two conditions are not met, the sale is void. This shall not be abridged for any reason.

Right XXIV:

At no time shall the exercise of one's Rights extend so far as to deprivation of the rights of another.

Right XXV:

The Republic of North Dakota shall have no right or jurisdiction to either allow or disallow the Holy union of a consenting man and woman by any means whatsoever.

Right XXVI:

No soldier shall be quartered in any house or building owned by the People of the Republic of North Dakota without their expressed consent at any time; nor any soldier of the Republic of North Dakota, except during times of defense of the Republic, and only for such tenure as absolutely necessary: the soldiers being required to respect the rules of home or place and shall be privately liable for any unlawful actions.

Right XXVII:

The Powers not delegated to the Republic of North Dakota by this Constitution, or prohibited by it to the Counties, are reserved to the Counties respectively, or to the People. Again, the People of the Republic of North Dakota retain the ultimate sovereign Power, limited only by the Rights of others to equally expect the same freedoms others within the Republic of North Dakota expect to maintain.
